Shopmarkx: We, are a digital design business based in Ireland operating the website Shopmarkx.com. We sell original artwork and printable designs both as downloadable digital files and as made-to-order, print-on-demand physical products.

By placing an order through the site, the customer/you agree to be bound by these Terms & Conditions.

1. Nature Of Our Products

Shopmarkx (Shopmarkx.com) sells two distinct types of products:

Digital Products — downloadable files. Upon completing a purchase, you receive a license to download and use a digital file (such as a JPG, PDF, and/or PNG) for the purpose described at the time of purchase. No physical item will be shipped to you for these products under any circumstances.

Print-on-Demand (POD) Products — physical items (such as framed prints, canvas prints, posters, stickers, or apparels) that are individually manufactured and shipped to you following your order. These are made to order and are not held as pre-made stock. Each product listing clearly states whether it is a digital download or a physical POD product before purchase.

POD products are produced and fulfilled on our behalf by a third-party production partner. Details of our current production partner(s) are available on request or as disclosed on the relevant product listing, in accordance with applicable marketplace and consumer transparency requirements.

2. Orders & Acceptance

Placing an order through the site constitutes an offer to purchase a digital product and confirms that the information you provide is accurate and complete.
You are authorized to use the payment method provided.
We reserve the right to refuse or cancel any order at our discretion, including in case of suspected fraud, pricing errors, or technical errors, prior to delivery (digital products) or prior to production commencing (POD products). If we cancel an order after payment has been taken, you will receive a full refund.
An order is accepted, and a contract formed, once we make the digital download available to you and/or send confirmation of your purchase by email.
For POD products, an order is accepted, and a contract formed, once we send confirmation of your purchase by email and production has been scheduled with our production partner.

3. Pricing & Payment

All prices are displayed in official local currencies (e.g., US – $ US Dollar; Eurozone Countries – € Euro; UK – £ Pound Sterling etc.) and are inclusive/exclusive of any applicable VAT as noted at checkout.
For POD products, displayed prices include production costs; shipping costs are shown separately at checkout unless stated as included in the listing.
Payment must be received in full before access to the digital download is provided, or before production of a POD order begins.

We use PayPal payment provider to process payments securely. We do not store your full payment card(s) details.
We reserve the right to update prices at any time but changes will not affect orders already confirmed.

Special Offers

Shopmarkx (Shopmarkx.com) may from time to time provide special offers on the website which may have more favourable conditions than those set forth in these General Conditions such as with respect to payment or extended right of withdrawal.

Such conditions will apply for the duration of the special offer and for the specific products set forth by Shopmarkx (Shopmarkx.com) in connection therewith. Withdrawing such special offers is at the exclusive discretion of Shopmarkx (Shopmarkx.com) at any time.

Upon termination or withdrawal of a special offer, these General Conditions shall apply without any amendments.

4. Delivery Of Digital Products

Digital Products — upon successful payment, you will receive access to your digital file(s) via a download link, provided either immediately on the confirmation page, or by email, or through your account order history if you created an account.

It is your responsibility to ensure the email address provided at checkout is accurate, as this is how your download link will be delivered.
If you experience any issue accessing your download, contact us at info@shopmarkx.com and we will assist you promptly.

POD Products — Following your order, your item is individually produced by our production partner. Estimated production and shipping times are stated on the relevant product listing; these are estimates only and not guaranteed delivery dates, as actual timing depends on our production partner and the shipping carrier. You will receive shipping confirmation, including tracking information where available, once your order has been dispatched. For international orders, you are responsible for any customs duties, import taxes, or related fees imposed by your destination country; these are not included in the product price or shipping cost unless explicitly stated.

5. Right Of Withdrawal (EU Cooling-Off Period) & Digital Content

Right Of Withdrawal (EU Cooling-Off Period) Under the EU Consumer Rights Directive and the Irish European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, consumers in the EU generally have a “14-day right of withdrawal” from a distance contract without giving any reason. This right does not apply in the following circumstances relevant to our products:

(a) Digital Content — the withdrawal right does not apply once performance of a digital content contract has begun, provided that:

You have given your “prior express consent” to the immediate delivery/download of the digital content, and
You have acknowledged that you thereby lose your right of withdrawal once download begins. By completing checkout and accessing your download, you expressly consent to immediate delivery of the digital content and acknowledge that your right of withdrawal is lost from that point onward, in accordance with Article 16(m) of the EU Consumer Rights Directive.

(b) POD Products — the withdrawal right does not apply to goods that are made to your specifications or are clearly personalized, in accordance with Article 16(c) of the EU Consumer Rights Directive. As POD products are manufactured individually for your specific order rather than held as pre-made stock, this exemption applies once production has commenced. We recommend reviewing your order carefully before confirming purchase, as cancellation may not be possible once production has begun.

For customers “outside the EU” (including US based customers) this statutory withdrawal right does not apply in the same way, but our refund policy below still governs.

6. Refunds

(a) Digital Products —

Due to the instant, downloadable nature of our products, “all sales are final once the digital file has been downloaded or accessed”, except as required by law or as set out below.
If a file is corrupted, is the wrong file, or otherwise fails to function as described, contact us at info@shopmarkx.com and we will provide a replacement file or a refund at our discretion.

This does not affect your statutory rights, including your right to have a genuine defect resolved within the timeframes set out under applicable consumer protection law.

(b) POD Products —

As each POD item is custom-produced for your order, we are unable to accept returns or exchanges for reasons of personal preference (such as ordering the wrong size, or a change of mind), once production has commenced. If your POD item arrives damaged, defective, or does not match its listing description, please contact us within 30 days of delivery, with photographic evidence where possible, and we will arrange a replacement or refund at our discretion, in line with the remedy offered by our production partner.

Nothing in this section affects your statutory rights as a consumer, including any rights under the Irish Sale of Goods and Supply of Services Act 1980 (as amended), the EU Digital Content Directive 2019/770 (relating to digital content that is not as described, defective, or not fit for purpose), or the EU Sale of Goods Directive 2019/771 (relating to the conformity of physical goods).

7. License To Use Purchased Designs

When you purchase a digital product from Shopmarkx (Shopmarkx.com), you are granted a limited, non-exclusive, non-transferrable license for personal use only, including:

Printing the design for your own personal or home use
Displaying the printed design in your own home

When you purchase a POD product, you own the physical item itself, but the underlying design remains our intellectual property under the same license terms — you may display the item in your home, but you may not reproduce, scan, photograph for redistribution, or otherwise copy the design from the physical product.

In both cases, you may not:

Resell, redistribute, or share the digital file itself, in whole or in part
Reproduce or copy the design from a purchased POD product for further distribution or sale
Use the design for commercial purposes (including reselling printed copies, using it in a business, or incorporating it into products for sale) without our prior written permission
Claim the design as your own original work

All designs remain the intellectual property of Shopmarkx (Shopmarkx.com). Unauthorised use may result in legal action.

8. Custom Orders

If you submit a custom order request, no contract exists and no payment is due until we confirm the scope, pricing, and timeline with you directly. Custom designs are subject to the same license terms in Section 7 once delivered, unless otherwise agreed in writing. Where a custom order results in a physical POD product, the provisions of Sections 4(b), 5(b), and 6(b) also apply.

9. Limitation Of Liability

Digital products are provided ‘as is’ and ‘as available.’

Colors may appear slightly different depending on your monitor calibration or printer settings; files are provided as designed, and we cannot guarantee exact color matching across all devices. For POD products, minor variations in color, material, or finish may occur due to production processes and are not considered a defect unless they substantially differ from the listing description.

To the fullest extent permitted by law, Shopmarkx (Shopmarkx.com) shall not be liable for any indirect, incidental, or consequential damages arising from your use of the site or purchased digital products. This does not exclude or limit our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Irish or EU law.

10. Data Protection

Your personal data is processed in accordance with our Privacy Policy, which complies with the EU General Data Protection Regulation (GDPR) and the Irish Data Protection Act 2018. For POD orders, your name and delivery address are shared with our production partner solely for the purpose of fulfilling your order. Please refer to our Privacy Policy for full details on how we collect, use, and protect your information.

11. Governing Law & Disputes

These Terms & Conditions are governed by the laws of Ireland. Any disputes arising from these terms or your use of the site shall be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to any mandatory consumer protection rights you may have in your own country of residence if you are an EU consumer.
